Please read these Terms of Service ("Terms") carefully before using this website. By accessing or placing an order through hearthandhaven.studio (the "Site"), you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Us

Hearth & Haven ("we," "us," "our") is a sole proprietorship registered and operating in the State of North Carolina, United States. "You" and "your" refer to any individual who accesses or uses the Site or places an order.

2. Acceptance of Terms

Your access to and use of the Site constitutes your unconditional acceptance of these Terms, our Privacy Policy, and our Returns Policy. These Terms apply to all visitors, customers, and other users of the Site. If you are placing an order on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Permitted Use; Prohibited Conduct

You may use the Site for lawful personal and commercial purchasing purposes only. You agree not to:

Attempt to gain unauthorized access to any part of the Site, its servers, or any database connected to it;

4. Products and Pricing

Accuracy. We make reasonable efforts to ensure that product descriptions, dimensions, materials, images, and pricing displayed on the Site are accurate. However, we do not warrant that all information is error-free, complete, or current.

Pricing errors. If a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel or refuse any order placed at the incorrect price. If your order is affected, we will notify you promptly and offer you the option to (a) confirm the order at the correct price or (b) cancel the order for a full refund. We will not charge your payment method until we have your confirmation where a material pricing discrepancy exists.

Currency. All prices are listed in United States Dollars (USD).

Availability. All products are subject to availability. We reserve the right to discontinue any product at any time.

Quantity limits. We reserve the right to limit order quantities per customer, per household, or per order at our sole discretion, including in cases of suspected resale, fraud, or abuse.

5. Orders and Contract Formation

Placing an order through the Site constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to decline or cancel any order at any time prior to fulfillment for reasons including but not limited to product unavailability, payment issues, or suspected fraud, in which case any amounts charged will be refunded in full.

6. Payment

Payment is processed through Shopify Payments and/or PayPal at checkout. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided. We do not store your full payment card details on our systems.

7. Taxes

Applicable sales and use tax will be collected on orders where required by law. Hearth & Haven is registered to collect sales tax in North Carolina. Tax obligations in other states are determined by applicable nexus rules and may change over time. You are solely responsible for any taxes, duties, or customs fees applicable to orders shipped outside the United States.

8. Shipping and Returns

Shipping terms are set out in our Shipping Policy. Return and refund terms are set out in our Returns Policy. Both policies are incorporated into these Terms by reference.

9. Intellectual Property

All content on the Site — including but not limited to the Hearth & Haven name, logo, product photography, written copy, and design — is the proprietary property of Hearth & Haven and is protected by applicable copyright, trademark, and other intellectual property laws.

You may share links to the Site and take personal, non-commercial screenshots for purposes such as sharing with a healthcare provider or gifting advisor. You may not reproduce, republish, distribute, sell, sublicense, modify, or create derivative works from any Site content without our prior written consent. Unauthorized use may give rise to a claim for damages and/or be a criminal offense.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEARTH & HAVEN AND ITS OWNER, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO A SPECIFIC PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ITEM GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or wilful misconduct; or (d) any liability that cannot be excluded or limited by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hearth & Haven and its owner, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services (such as Shopify, PayPal, or Pirate Ship). We are not responsible for the content, privacy practices, or terms of any third-party site or service. Links are provided for convenience only and do not constitute endorsement.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site that cannot be resolved informally by contacting us at hello@hearthandhaven.studio shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina, and you irrevocably consent to such jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Returns Policy, constitute the entire agreement between you and Hearth & Haven with respect to your use of the Site and supersede all prior agreements, representations, and understandings.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be indicated by an updated "Last Updated" date at the top of this page. Your continued use of the Site after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
